House District 51

You heard it here first, McNaught vs. Loveland Mayor Gene Pielin for House District 51 is a likely scenario for the vacated House District 51 seat. A few others are expressing interest but we have not yet confirmed they have announced they are running.

Pielin has a practical problem. He is looking for a credible Republican to nominate him at the vacancy committee meeting scheduled for Thursday August 13, 2009 at 7:00 pm in Loveland’s Pulliam Building in downtown Loveland beginning at 6:00 PM.

The appointment to fill the balance of Don Marastica’s vacated seat in the legislature will be made by the 80 member Larimer County Republican Party vacancy committee which is comprised of precinct committee members from within House District 51. That group is called the 51st Representative District Republican Central Committee.

If Pielin fails to get someone to endorse him he may abandon the pursuit in private and deny ever having an interest. A number of other names have surfaced but until the meeting anyone can be nominated including from the floor of the meeting itself.

    As a Jewish Republican I get tired of the Pielins and Marosticas telling us the “Christian Right” has taken over our party. Here is an excellent email I think is worth people seeing sent to the Republican leadership regarding Marostica;

    I think a lot of people will give Marostica a piece of their mind if he shows up at this to endorse Gene. I personally don’t think he will. Don is a salesman and this time there is nothing he can sell this crowd that benefits him personally. That will make the meeting a place he will steer clear of

    I think they said he is looking for a CREDIBLE Republican. Boucher is no longer credible.

    I am supporting Tom Buchanan (a fellow Marine) who does stand for this country like most people in the Republican Party.

    Please don’t judge our party by the Bill Kuafman – Don Marostica – Gene Pielin blame America first crowd. I know, if we dummies just paid more taxes all the roads would be fixed and the economy would be growing again.

    The tax and spend crowd have no business trying to run in the Republican party. Mark speak for yourself buddy!

    As to creating a blog – I work for a living, so there is little time for such pursuits.

    A few points to consider….

    1. Andrew Boucher cannot submit his name as he doesn’t live in the district

    2. If conservatives run against each other (McNaught & Buchanan) they risk alienating their supporters against the only other conservative choice if there is a run off which is a good thing for the party.

    3. Mayor Pielin doesn’t need someone to introduce him at this event. Steve Johnson, Kitty Wild or Evelyn King will be happy to do it if Don Marostica only asks them to do it.

    4. In case people forgot, it was Steve Johnson who wrote an endorsement for Mike Lynch and circulated it to the precinct members (I know cause I got one)

    5. I think Dan Betts whould be an excellent choice or Kitty Wild. Neither has said they will run which is too bad.

    As for the others – keep your rosary off my ovaries…

    The race to replace Rep. Don Marostica took an illegal turn today. Kevin Mcnaught who announced he is seeking the HD 51 seat has run into a constitutional problem.

    Article 5, Section 4 of the Colorado Constitution provides the “qualifications of members” for the Colorado state house and senate. That section states:

    “No person shall be a representative or senator who shall not have attained the age of twenty-five years, who shall not be a citizen of the United States, and who shall not for at least twelve months next preceding his election, have resided within the territory included in the limits of the district in which he shall be chosen.”

    Unfortunately for Mr. McNaught, he “resides” in Berthoud, Colorado outside “the territory included in the limits of the district.” He owns a rental property within the district which at one time he lived in and apparently has kept his voter registration address at the address for the rental property but he does not reside there.

    Therefore, he does not reside within the geographic limits of the district and he has not resided within the district for the previous twelve months.
    Instead of asking the Secretary of State for a ruling, Mr. McNaught contacted the Clerk of the Colorado House of Representatives to obtain her opinion while specifically contending the above constitutional provision only applies to regular primary and general elections but not to vacancy elections. Under his interpretation, the vacancy committee in HD 51 can select someone from Cortez to represent Loveland in the General Assembly.

    Needless to say, the Clerk of the House does not have any jurisdiction over the vacancy election. It is the Secretary of State who must certify all elections to the respective houses of the Colorado General Assembly.

    Even more importantly, the Colorado Constitution does not carve out an exception for vacancy elections. The mandatory qualificaitons provision applies to all elections, including vacancy elections.

    Mr. McNaught isn’t qualified constitutionally to represent HD 51.

    Ralph, you took that from a liberal blog who’s sole purpose is to smear R’s. The information you obtained from Coloradopols is not correct. He obtained legal counsel to make sure that he was qualified to run for HD51 before he threw his hat in the ring. He has lived in HD51 for 14 years, and nows has property in both disricts 49 and 51, and has his voter’s registration in HD51. Call the guy if want answers, don’t just cut and paste a bogus article written on a liberal blog.
